Terms and Conditions.
Counselling Contract
A counselling contract is initialised at the beginning of any new period of counselling. It helps us to come together in a safe and boundaried way, and for therapy to be offered ethically and professionally. Please see mine below or download with the button above. The aim of this contract is to promote good practice, understanding, mutual respect, equality, confidentiality, and consideration: - 1. This contract should be considered in conjunction with my ‘Privacy Policy’, ‘Data Protection Policy’ and my ‘Pre-online Counselling Information’. 2. All your sessions are conducted on Teams; a paid for secure and encrypted platform. However, it should be noted that no online setting can be 100% secure. 3. I am a member of BACP (The British Association of Counsellors & Psychotherapists). Membership no. 55603. As part of my membership, I agree to abide by BACP’s Ethical Framework: - https://www.bacp.co.uk/media/3103/bacp-ethical-framework-for-the-counselling-professions-2018.pdf 4. BACP’s Ethical Framework requires that I disclose your details to a relevant professional should you reveal a serious intent to cause harm to yourself or another. 5. I am also governed by the law and must disclose information should you reveal that you deal in drugs, human trafficking, child abuse, money laundering, terrorism, or have left the scene of a road accident where someone was injured. 6. To ensure professional standards and ethics I have 1.5hrs of supervision a month with a BACP registered and experienced online supervisor. I may discuss details of parts of our session, your identifying details would not be shared. 7. Please answer your assessment questions openly and honesty so that I can be sure I am qualified, insured, and competent to work with you. 8. You will participate in a counselling session under the influence of legal or illegal substances, unless on prescription. 9. Counselling sessions are by pre-agreed appointment only, between 10.00am and 8.00pm. 10. Counselling sessions costs vary and are as per my website. 11. Payment for each session is made in advance of each counselling session and made via PayPal or via bank transfer: – Bank. Name: Account No. Sort Code. 12. I do not charge for reasonable cancellations, however last-minute cancellations on the day of your appointment can rarely be filled and are therefore liable for full payment. 13. If you would benefit from reasonable adjustments, for example, regular comfort breaks for pain, eye strain, overwhelm etc. please let me know as soon as you realise, I will do my best to accommodate and support you. 14. In the case of tech failure as a backup plan, you would like to be contacted via: - Video - Phone – Text - Not Contacted 15. In the event I am unable to reconnect with you I will refunded the cost of the time missed in accordance with the session cost, i.e. a proportional part of the paid cost. 16. My records of your counselling session are kept on a Datashur encrypted secure memory stick in a secure environment. No handwritten notes are kept. Please see my GDPR statement for more details. 17. Should I be incapacitated or in the unfortunate event of my death, you will be notified as soon as is possible by my living will associate who is also a member of BACP. They will take responsibility to destroying all my client files; 10 wrong entries on my encrypted memory stick and it is designed to self-destruct. 18. In audio and video sessions you can disconnect at the click of a button, which is so much easier than walking out of an in-the-room session. Ending therapy in such a way does not mean you cannot come back. I offer a safe non-judgemental space, and you are welcome to return at any time. 19. You can change your chosen form of online therapy at any time, for example switching from audio (camera off) to video (camera on), or vice versa. 20. If under any circumstances I meet you outside of our therapy sessions, I will be guided by you as to whether we acknowledge we know each other. My default setting is not to acknowledge you to preserve your confidentiality and safety. 21. I am a tutor/lecturer at Iron Mill College in Exeter. For contractual and ethical reasons, I do not work with students who are actively on an Iron Mill course regardless of whether I am teaching you or not. Privacy Policy
The details below explain what details about you are kept, where they are kept, for how long, who will see them, and when they will be destroyed. Please see below or download with the button above. 1. My website is hosted by a third party, which may gather information via cookies that I have no control over. 2. Payments made through a third party, PayPal or Lloyds Bank, may gather information that I have no control over. 3. Your personal details (name and address) are kept separately from your assessment details and session notes. 4. Assessment details, which will contain, for example, details of the medication you are taking, are recorded so that any noticed red flag indicators can be highlighted to you. 5. Your notes are brief, to the point, memory joggers; nothing more. 6. A court can subpoena your notes, and I must legally submit them if the request complies with UK territory law/agreements. 7. Your notes are not shared with anyone else. The exception is my clinical will nominee, when should I become incapacitated or in the unfortunate event of my death, the nominated BACP registered therapist will contact you to advise you and then delete your details. 8. You can request to see your client notes at any time. 9. You are entitled to confidentiality in the event of your or my death. 10. Your session notes are kept on a Datashur encrypted secure memory stick in a secure environment. The memory stick is designed to self-destruct after 10 incorrect attempts to access it. 11. No handwritten notes are kept. 12. None of your details or notes are kept in iCloud. 13. Email details are password protected. 14. Entries in my phone are initials only; my phone is password protected. 15. Your client notes are retained for seven years in accordance with my insurance policy. Once the seven years are up, your notes are wiped from my encrypted memory stick. 16. If under any circumstances I have a data breach, I will follow BACP’s guidelines to: - • Take immediate action to prevent or limit any harm to you. • Attempt to repair any harm caused as much as is possible. • Apologise to you where appropriate. • Notify and discuss the event with my supervisor to ensure proper handling and support. • Investigate the breach thoroughly and implement measures to prevent a similar incident from occurring in the future.

These are the working Terms and Conditions of Therapy Creatively, which is run by Claire Shepherd, an independent Counsellor and Psychotherapist. They make a legal agreement between you the client and Claire Shepherd. Payment of any therapy session are as detailed on the Therapy Creatively website. Payment confirms your agreement to be legally bound by these Terms and Conditions. Clients should regularly review these Terms and Conditions as Therapy Creatively reserves the right to revise and update them at any time. If you do not accept these Terms and Conditions in their entirety you should not book or pay for an appointment. If you have any queries regarding these Terms and Conditions, your query to therapycreatively@proton.me and ask for clarification. Throughout Therapy Creatively’s website and any additional information, care has been taken to describe and show the services offered as accurately as possible. Despite this, errors may occur. Therapy Creatively makes every effort to ensure that all information displayed on the website and in additional information are accurate, however the right is reserved to alter pricing and additional information without notice. Appointments – initial appointments can be made by phone, text, or email. An appointment should not be deemed booked until full payment has been made. Bookings – all therapy sessions are by appointment only. Payment should be made as soon as your booking has been made to ensure reservation. Cancellations – a cancelled appointment requires 24 hours’ notice for a full refund. If Therapy Creatively cancels your appointment, you will be offered a replacement appointment at a date and time that is mutually agreed. If Therapy Creatively cannot offer you a suitable replacement session your money will be refunded in full. Confidentiality – your privacy is of the utmost concern to Therapy Creatively, what you say within your sessions is confidential. However, The British Association of Counsellors and Psychotherapists Codes of Ethics specifically requires clinical supervision. Therapy Creatively only uses supervisors who are also governed by BACP’s ethical framework and consider shared client details to be confidential. The only time Therapy Creatively or the supervisor are legally bound to disclose confidential information is when there are details of serious-harm or serious-crime. In the event of serious-crime you would not be notified before a disclosure is made as this is deemed ‘tipping off’. Contact Details – Therapy Creatively will request suitable contact details from you, these details are important in case you have a medical emergency during an online session and emergency help needs to be summonsed. Therapy Creatively cannot work with individuals who wish to withhold their details. Copyright – Therapy Creatively’s website contains copyrighted material, trademarks, and other proprietary information, including, but not limited to, text, photos, video, graphics, and the entire content of the website which is copyrighted as a collective work under UK and International copyright laws. Therapy Creatively run by Claire Shepherd owns a copyright in the selection, co-ordination, arrangement, and enhancement of such content, as well as in the content original to it. Users may not modify, publish, transmit, distribute, post, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part. Except, as otherwise expressly permitted under copyright law or these Terms and Conditions; no copying, redistribution, retransmission, publication, or commercial or non-commercial exploitation of downloaded material will be permitted without the express written permission of Therapy Creatively’s owner Claire Shepherd. Disability – Therapy Creatively will make every effort to make reasonable adjustments to accommodate any notified disability. If a requested accommodation cannot be reasonably be made you will be notified in writing prior to the session and if necessary, any payment made refunded in full. Disclaimer – If you are taking prescription drugs during your therapy sessions you should not stop taking them without consulting your GP or relevant medical professional. If you wish to stop taking prescription drugs, addictive drugs, or banned substances, Therapy Creatively can write to your GP on your behalf and with your consent to formalise an action plan. All letters are charged at £25.00 each. Ethics – Therapy Creatively’s owner Claire Shepherd is a registered member of the British Association of Counsellors and Psychotherapists and abides by their ethical framework a copy of which can be viewed on their website at www.bacp.co.uk. If you feel any part of this ethical framework has been breached Claire asks that you, or someone acting on your behalf, notify her as soon as possible so that every effort can be made to rectify the situation. If you feel the situation has not been successfully resolved, you can formally complain to BACP quoting her membership number: 055603. Governing Law & Jurisdiction -These Terms and Conditions shall be governed by and construed in accordance with English Law. Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts, where the claim is brought by you, save where you have legal rights to bring any claim in respect of such a dispute in any other jurisdiction. Therapy Creatively’s owner Claire Shepherd retains the right to bring proceedings against you, for any threatened or actual breach of these Terms and Conditions in your country of residence. Therapy Creatively’s owner Claire Shepherd does not warrant that therapy services or information for sale on this website are appropriate for use outside the United Kingdom. It is prohibited to access this website from territories where its contents are illegal or unlawful. If you access this website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws. If any provision of these Terms and Conditions is, for any reason, invalid and/or unenforceable as determined in an appropriate court of proper jurisdiction, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law. Users agree to replace an invalid/ unenforceable provision with an enforceable provision that most closely approximates the intent and economic effect of the invalid/ unenforceable provision and shall be interpreted most favourable, when possible to the benefit of the company. Health & Safety – Therapy Creatively makes every effort to risk assess and provide a safe and secure environment for therapy. If you should notice a health and safety risks you are requested to notify Claire immediately so that the matter can be addressed as necessary. Information – you will be asked to supply personal information, failure to supply relevant details when requested may result in Therapy Creatively’s inability to work effectively with you. This is particularly relevant to requested details of prescription drugs, addiction, and current/previous diagnosed mental health problems. Limitation of Liability – the information, products, services, and other material included in, or available through Therapy Creatively’s website, may not be complete, and may include errors or inaccuracies, and may be modified, discontinued, or deleted without notice. Therapy Creatively’s owner Claire Shepherd specifically disclaims any, and all responsibility or liability for the accuracy. Content, completeness, legality, reliability, or availability now, or in the future. Advice, information, and other materials suppled by Therapy Creatively either downloaded from this site or obtained during therapy sessions should not be relied upon for personal, medial, legal, business, financial or other decisions. Therapy Creatively disclaims any responsibility or liability for deletion, failure-to-store, miss-delivery, viruses, loss of data, or untimely delivery of an information or material through use of her website or any third-party links on it. You access and use the services provided at your own discretion and risk. No part of Therapy Creatively’s website or any therapy session is a substitute for medical advice. When using this website, the user is solely responsible for any damage incurred to their computer system or data thereon. Therapy Creatively disclaims any responsibility for any harm resulting from downloading or accessing any information or materials on the internet through her website. Under no circumstance is Therapy Creatively’s owner Claire Shepherd liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond her reasonable control – including without limitation, internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil insurrections, civil disturbances, shortages of labour or material, fires, floods, storms, explosions, acts of god, war, government actions, order of domestic or foreign courts or tribunals, non-performance of 3rd parties, or loss of or fluctuation in heating, light, or air conditioning. Online Acceptance – Therapy Creatively website users may not assign, sub-license, or otherwise transfer any rights under these Terms and Conditions. If any provision of these Terms and Conditions is found by any court of competent jurisdiction to be invalid, the invalidity of the provision shall not affect the validity of the remaining provisions, which shall continue to have full force and effect. No person other than the parties to these Terms and Conditions is intended to benefit from them, pursuant to ‘The Contracts (rights of third parties) Act’ 1999. These terms represent the entire understanding between the User and the Company, they supersede any prior statements, representations or terms and conditions. Online Therapy – Therapy Creatively cannot be held responsible for the security measures provided by third party meeting hosts, web hosts, and money transfer agents. Their service are used in good faith. Neither can Therapy Creatively be held responsible for confidentiality/security of your chosen login point/location. Payment – Bookings are deemed to have been placed once payment has been received. Payments are made via bank transfer. Privacy Policy - Cookies are in use on Claire Eva Shepherd’s website by her webhost Wix.com. By using the website, you consent to the collection and use of your cookie information by Wix.com. Refunds – refunds will be completed within three working days of cancellation and with the provision of any necessary bank details. Refusal –Therapy Creatively reserves the right to refuse to provide any booked therapy session if in her opinion, it is not suitable for the person concerned, is unethical, or would cause disruption to other users. In such circumstances a full refund would be issued as per the refund policy. Under 18 – Claire Eva Shepherd does not offer therapy to under people under 18yrs of age. Use of services should only be booked by persons over the required age. These terms and conditions do not affect your statutory rights.
